In this documentary and descriptive research investigation, the researchers analyze (1) the laws related to the fiscal decentralization to local government in accordance with the Constitution of the Kingdom of Thailand B.E. 2560 (2017); compare (2) the people’s participation in various relevant laws; analyze (3) the weaknesses and strengths in the implementation of the decentralization to local government in accordance with the constitution of the Kingdom of Thailand B.E. 2560 (2017); and propose (4) practical guidelines to encourage the people’s participation in the decentralization to local government process in accordance with the Constitution of the Kingdom of Thailand, B.E. 2560 (2017). Findings show that there are eight laws and regulations at a national and local level related to fiscal decentralization to local government. However, no laws or regulations specify a direct participatory budgeting process. Guidelines and practices concerning fiscal participation therefore are unclear. At times there are conflicts and resolutions cannot be reached. An amendment of the laws has sought to define more clearly the guidelines and practices concerning the people’s participation to provide more clarity to the fiscal decentralization procedures. A draft Act on the People’s Participation in the Public Policy Process is being considered by the National Legislative Assembly.

        การวิจัยในครั้งนี้มีวัตถุประสงค์ในการศึกษาคือ (1) เพื่อวิเคราะห์กฎหมายที่เกี่ยวข้องกับการกระจายอำนาจทางการคลังให้แก่องค์กรปกครองส่วนท้องถิ่นตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.๒๕๖๐ (2) เพื่อเปรียบเทียบการมีส่วนร่วมของประชาชนในกฎหมายฉบับต่าง ๆ (3) เพื่อวิเคราะห์จุดอ่อนจุดแข็งในการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่นตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.๒๕๖๐ และ (4) เพื่อเสนอแนะแนวทางในการนำไปปฏิบัติให้ประชาชนมีส่วนร่วมในการกระจายอำนาจให้แก่องค์กรปกครองส่วนท้องถิ่นตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.๒๕๖๐ ในการวิจัยครั้งนี้จะใช้การวิจัยเอกสารประกอบกับการวิจัยแบบพรรณนา ผลการศึกษาพบว่า กฎหมาย และระเบียบต่างๆทั้งระดับชาติและระดับท้องถิ่นที่เกี่ยวข้องกับการกระจายอำนาจทางการคลังให้แก่องค์กรปกครองส่วนท้องถิ่นมีอย่างน้อย ๘ ฉบับแต่ยังไม่มีฉบับใดที่ระบุถึงกระบวนการงบประมาณแบบมีส่วนร่วมโดยตรง ทำให้แนวทางและหลักปฏิบัติเกี่ยวกับการมีส่วนร่วมทางการคลัง ยังไม่มีความชัดเจน ซึ่งหลายครั้งได้ก่อให้เกิดความขัดแย้งและหาข้อสรุปไม่ได้ การปรับปรุงกฎหมายต่างๆได้มีความพยายามกำหนดให้แนวทางและหลักปฏิบัติเกี่ยวกับการมีส่วนร่วมของประชาชนมีความชัดเจนมากยิ่งขึ้น โดยออกมาเป็นร่างพระราชบัญญัติการมีส่วนร่วมของประชาชนในกระบวนการนโยบายสาธารณะซึ่งอยู่ในระหว่างการพิจารณาของสภานิติบัญญัติแห่งชาติ
